NEW YORK - The fight Apple's App Store for patenting the term of its online applications store is not believed to be easy. Moreover, associated with a lawsuit against Amazon is using a similar name.

Similarly, claims District Judge for the Oakland federal court, Phyllis Hamilton, as reported by Cellular News, Monday (27/06/2011).

Hamilton said he would re-read all the documents supporting the Apple lawsuit. But he believes the technology giant's Cupertino home will face a big hurdle to prove that the public would be confused with the terms of Apple's App Store and Amazon.

Last March, Apple sent a lawsuit in federal court in Oakland, Northern California. Amazon has arbitrarily accuse Apple trademarks App Store so use 'misleading' customers.

"We demand that Amazon does not mimic the name of the App Store because it will confuse and mislead customers," said Apple spokeswoman Kristin Huguet time.

Based on claims Apple, Amazon is considered to have violated the law relating to use of the name of the App Store in "Amazon AppStore Developer Portal", as well as in advertisements for one of the mobile game version of the phenomenal Angry Birds.
